The Ownership Promise

Your AI. Your Data. Your Technology. Our expertise. No lock-in.

Managed services should not become a trap. We keep your accounts, licenses and data in your control wherever practical, and we put ownership of custom work in writing instead of leaving it to assumption.

01

What stays yours

Our engagements are designed so that:

  • Accounts with AI providers, cloud platforms and builders are in your organization’s name where practical, subject to each vendor’s terms
  • Software and AI licenses are contracted to you and billed directly when appropriate, subject to the vendor’s license terms
  • Your data remains yours, in systems you control or can export from
  • Custom deliverables that your signed agreement assigns to you are yours
  • Documentation of configurations and access is provided as agreed

02

How ownership of custom work is decided

Ownership of custom intellectual property — including application source code — is defined explicitly in your signed agreement or Order. Where no separate agreement says otherwise, the Growth Mode Terms of Service control. Under those Terms, custom application source code is licensed for your internal business use unless an Order expressly transfers ownership. If owning source code or other custom work matters to you, raise it during scoping so it can be written into your agreement.

03

What stays with others

Some things do not transfer, and we say so up front.

  • Growth Mode’s pre-existing and reusable intellectual property — components, frameworks, tools and methods — remains Growth Mode’s; where it is part of a deliverable, your use of it is licensed as your agreement and the Terms describe
  • Third-party intellectual property, tools and platforms stay with their licensors and are governed by their terms
  • Growth Mode products such as LiveDashboard.app or OfficeCalling.com are services you subscribe to, not deliverables

04

Delegated access, not custody

We prefer client-owned AWS and provider accounts with delegated Growth Mode access. Ending a relationship means revoking our access, not negotiating for your infrastructure.

GMTWhat we manage
  • Account and license inventory in your name
  • Delegated, revocable access for Growth Mode
  • Written record of what is in scope and who owns it
  • Exit support described in your agreement

This page summarizes our approach; it does not change the Growth Mode Terms of Service or any agreement. Ownership, licensing and any transfer of rights are governed by your signed agreement and Order and, absent a separate agreement, by the Terms of Service (see sections 36–38 on intellectual property).

FAQCommon questions
Will we own the source code for custom software?

Only if your signed agreement or Order says so. Under the default Terms of Service, custom application source code is licensed to you for internal business purposes unless an Order expressly transfers ownership. Ownership transfer can be discussed during scoping.

What happens to our accounts if we stop working with you?

If accounts are in your name, you keep them, subject to the vendor’s terms. We remove our delegated access and provide agreed handover documentation.

Do you ever hold accounts for clients?

Sometimes it is necessary or more practical, such as hosted environments we operate. When that happens, the agreement documents it and how data can be exported.
